1. Who you're contracting with
These terms are between you and Party with Zoe ("Party with Zoe", "we", "us", "our"), the trading name of the kids' party entertainment business operated from Auckland, New Zealand, contactable at zoe@partywithzoe.com.
2. Acceptance
By booking a party, paying for a package, or otherwise using our website you agree to these terms. If you don't agree, please don't book.
3. Authority
You confirm that you are at least 18 years old (or have a parent/guardian's consent) and that you have authority to make the booking on behalf of everyone in your party.
4. The service
We provide character entertainment, music, dance, balloons, bubbles and related activities for children's parties. The exact inclusions depend on the package you select at booking. We'll do our best to deliver the experience as described, but minor variations (e.g. activity order, costume detail) may occur.
5. Bookings, payment and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax and refund mechanics are governed by Paddle's Buyer Terms.
6. Refunds and cancellations
See our Refund Policy for the details. In short: full refund within 30 days of booking, requested via Paddle.
7. Acceptable use
You agree not to:
- use the service for any unlawful purpose;
- commit fraud or send spam through our forms;
- infringe anyone's intellectual property;
- interfere with the security or integrity of our website (e.g. malware, probing, scraping);
- create unsafe conditions for our entertainers at the event location.
8. Intellectual property
The Party with Zoe brand, characters, photography, written content and website are owned by us. You're welcome to share photos of your own party — please don't copy our content for commercial use without permission.
9. Service level
We aim to keep the website available and bookings running smoothly, but we don't guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties (merchantability, fitness for purpose).
10. Suspension and termination
We may suspend or cancel a booking for: material breach of these terms, non-payment, safety or fraud risk, or repeated abusive behaviour toward our entertainers. Where a cancellation is our fault, you'll receive a full refund.
11. Liability
To the fullest extent permitted by law, our aggregate liability to you is capped at the amount you paid for the affected booking. We're not liable for indirect or consequential losses (e.g. loss of profits, loss of goodwill). Nothing in these terms limits liability for fraud, death or personal injury caused by negligence where the law doesn't allow such limitation.
12. Indemnity
You agree to indemnify us for claims arising from your unlawful use of the service, your breach of these terms, or content you provide that infringes someone else's rights.
13. Governing law
These terms are governed by the laws of New Zealand, and the courts of New Zealand have exclusive jurisdiction over any dispute.
14. Force majeure
We're not responsible for failure to perform due to events beyond our reasonable control (severe weather, power outage, illness, government order). Where this prevents us delivering a booking, we'll work with you to reschedule or refund.
15. Changes to these terms
We may update these terms from time to time. The "Last updated" date above will change when we do.
